Honorable Emmanuel Ukpong-Udo, who represents the Ikono/Ini Federal Constituency in the House of Representatives from Akwa Ibom State, had his election victory overturned by the Appeal Court in the Federal Capital Territory, Abuja. The court upheld the decision of the election petition tribunal, which ruled that the Independent National Electoral Commission (INEC) violated the Electoral Act 2022, Regulations, Guidelines, and Manual for Election Officials by declaring and returning Ukpong-Udo.

The tribunal nullified the election and ordered a supplementary election in the polling units where the initial election was not held within the constituency. There are 33 polling units in total for the supplementary election to determine the rightful winner.

Initially, Ukpong-Udo was declared the winner by INEC with 19,926 votes in the February 25 House of Representatives election for Ikono/Ini Federal Constituency. However, the People’s Democratic Party (PDP) candidate, Dr Glory Edet, who garnered 15,765 votes, contested the decision. INEC had deemed the election inconclusive due to issues of violence, leading to a rescheduled supplementary election. However, the court deemed this action contrary to the Electoral Act.

After complications arose during the supplementary election, INEC cancelled the process. Despite the cancellation, the electoral body declared Ukpong-Udo as the winner almost a month later. Dissatisfied with this outcome, Dr Glory Edet sought the tribunal’s intervention, represented by her counsel Senior Advocate of Nigeria (SAN) Uwemedimo Nwoko, to invalidate Ukpong-Udo’s return.
